eRecording

eRecording allows financial institutions, law firms and other businesses involved in real estate transactions to submit documents electronically for recording. Recorded documents are returned faster than waiting to receive them back through the mail in 7-10 business days.

Our recording hours are 8:30am – 5:00pm, Monday – Friday minus county holidays. It is important to submit documents with your vendor before 3:00pm to ensure recording in the same business day.

 


Requirements

All customers must have an agreement in place with an approved vendor. Only original documents can be used to create the electronic document. Scanned images must be legible and reproducible. Be diligent in ensuring that documents submitted for Electronic Recording are checked before submission for errors, omissions, scanning defects, illegible areas, and other deficiencies that would affect the Recorder’s ability to record the document and the public notice to be created.

Sufficient space is needed for the electronic recording label in the top right corner of the 1st page.

 


Rejected Documents

Rush County reviews each document for statutory requirements and will immediately send back any documents that do not fill those requirements. This provides you with a quick turnaround time for errors to be fixed.

 

Top 5 Reject Reasons

  1. Legal description omitted or incorrect
  2. Notary acknowledgement incorrect or missing information
  3. Sales Validation Questionnaire or Exemption Number must accompany a deed
  4. Type or print names under signature. (KS Statue, Sec 28-115 as amended)
  5. Sufficient space was not provided for the eRecording label
